Halcyon List ("Halcyon," "we") is a Texas-licensed real estate brokerage. We collect personal information from sellers, buyers, and visitors to help us do our job: listing homes, supporting transactions, and complying with real-estate law.
1. What we collect
Information you give us directly
- Your name, email, phone number, and mailing address
- Property details — address, beds and baths, square footage, condition, HOA info, photos, descriptions
- Seller legal identity for TREC document fill — legal name, mailing address, entity name if applicable
- Seller's disclosure responses — occupancy, defects, flood and environmental knowledge, and other items required by Texas Property Code §5.008
- Payment and closing information at settlement
- Communications with us (email, chat, support)
Information we collect automatically
- Pages visited, time spent, device type, IP address, browser type
- Cookies (see Section 6 below)
Information from third parties
- Public-records data from address-enrichment providers (property characteristics, ownership, legal description, market value, assessed value)
- Identity verification responses if we use a third-party verification service
2. How we use it
- Run your transaction: list your home, prepare TREC documents, route to MLS, support negotiation and closing
- Verify identity and prevent fraud
- Communicate with you about your account, listing, transaction, and our services
- Comply with TREC record retention rules (at least four years), tax law, and other legal obligations
- Improve the Site and our services
- Send marketing emails — you can unsubscribe from these at any time
We do not sell personal information.
3. Who we share it with
- Service providers — companies we hire to help operate the Site (hosting, email, e-signature, identity verification, analytics, property-data enrichment). They handle your data per contract and may not use it for any other purpose.
- MLS and syndication partners (Zillow, Realtor.com, etc.) — your listing information becomes part of public market data when your home goes live on MLS.
- Transaction parties — your transaction coordinator, broker, buyer, buyer's agent, title company, lender, and others involved in your closing.
- Government, courts, and regulators — when required by subpoena, regulation (including TREC audits), or otherwise compelled by law.
- Other professionals you authorize — attorney, accountant, advisor of your choosing.
4. Where we store it
Your data is stored in cloud infrastructure located in the United States. Documents are stored encrypted in Amazon S3. Identity verification responses are held by our third-party verification provider per their privacy policy.
5. How long we keep it
- Transaction records (signed documents, offers, contracts): at least four years after closing, as required by TREC.
- Account information: while your account is active, plus four years after.
- Marketing data: until you unsubscribe.
Some data may be retained longer if a legal hold, regulatory inquiry, or pending claim requires it.
6. Cookies and analytics
We use cookies for:
- Authentication — keeping you signed in
- Site preferences
- Analytics — understanding which pages help and which don't
You can turn off cookies in your browser settings. Some Site features may not work without them.
7. Your rights
Attorney review: confirm whether Halcyon meets a Texas Data Privacy and Security Act (TDPSA) small-business exemption, and whether to add specific California (CCPA), Virginia (VCDPA), Colorado (CPA), or other state-rights sections.
Texas, California, and many other states give you certain rights about your personal information. We honor:
- Access — ask us what we have about you
- Correction — ask us to fix incorrect information
- Deletion — ask us to delete your information. Note: we cannot delete signed transaction documents that TREC requires us to retain for four years.
- Opt-out of marketing email — every marketing email has an unsubscribe link
- Portability — ask us for a machine-readable copy of your transaction data

8. Children
The Site is not for anyone under 18. We do not knowingly collect data from children. If you believe we have, contact us and we will delete it.
9. Security
We protect your data with industry-standard encryption (in transit and at rest), authentication, access controls, and audit logging. No system is perfectly secure — if a breach affects your personal information, we will notify you in accordance with Texas Business and Commerce Code §521.053 and any other applicable law.
10. Changes
We may update this Privacy Policy from time to time. We'll post the new policy on this page and update the "Last updated" date. Material changes will be emailed to existing customers.
